surety bond SUR•E•TY BOND (noun)

  1. A surety bond is a contract between three parties—the principal (you), the surety (us) and the obligee (the entity requiring the bond)—in which the surety financially guarantees to an obligee that the principal will act in accordance with the terms established by the bond.
  2. A guarantee issued by a surety agency on behalf of a client, requiring the agency to pay a sum of money to a third party in the event the client fails to fulfill certain obligations.
  3. A bond issued by one party, the surety, guaranteeing that he will perform certain acts promised by another or pay a stipulated sum, up to the bond limit, in lieu of performance, should the principle fail to perform.
  4. In a criminal case, the surety (or bail) bond assures the appearance of the defendant or the repayment of bailforfeited upon the defendant’s failure to appear in court.

Companies and government agencies that sign contracts with companies with surety bonds can:

  • Protect against financial loss in the event that promised labor is not performed.
  • Protect against liability in the event that the work causes damage.
  • Protect the obligee from financial losses in the event that one of your employees steals from them, or commits fraud.

These bonds fall into one of the following groups:

  • Contract bonds (construction and miscellaneous)
  • Court bonds (including fiduciary)
  • Federal bonds
  • License and permit bonds
  • Miscellaneous bonds
  • Public official bonds (including notary publics)

There is a lot of information being shared online about filing against one’s surety bond. It is critical that you do your due diligence before proceeding with the initial information gathering for procuring copies of someone’s surety bond. It is in your best interest to first familiarize yourself with all of the pieces of the puzzle: parties involved in the bond life cycle, the FOIA process, notice of intent, how to file against a bond, possible ramifications of filing against someone’s bond for both the filer and bond holder, and the litigation process. Do not take filing against someone’s surety bonds lightly; once you initiate the process you must be committed to pursing it from beginning to end, with the strong possibility of ending up in litigation proving your case against the insurance company. Long story short, do your research.

Definitions

"School board" means the governing body of any district created or operating under authority of this Act, including board of school directors and board of education. When the context so indicates it also means the governing body of any non-high school district and of any special charter district, including board of school inspectors.

"Special charter district" means any city, township or district organized into a school district, under a special Act or charter of the General Assembly or in which schools are now managed and operating within such unit in whole or in part under the terms of such special Act or charter.

"Charter School" - As of July 1, 2020, Public Act 101-0543 abolished the Illinois State Charter School Commission and transferred the existing charters under their authority to the Illinois State Board of Education.  As the authorizer for these schools, the State Board is responsible for ensuring these schools are in compliance with the Illinois Charter Schools Law and their charter agreements.  This includes monitoring of academic performance, fiscal health and organizational governance.  The State Board will also manage the renewal process of all state-authorized charters seeking to renew their charter agreements at the expiration of their terms.

The terms "common schools", "free schools" and "public schools" are used interchangeably.

"Illinois State Board of Education (ISBE)" as defined in the Illinois Constitution:

SECTION 2. STATE BOARD OF EDUCATION - CHIEF STATE EDUCATIONAL
OFFICER
    (a)  There is created a State Board of Education to be
elected or selected on a regional basis. The number of
members, their qualifications, terms of office and manner of
election or selection shall be provided by law. The Board,
except as limited by law, may establish goals, determine
policies, provide for planning and evaluating education
programs and recommend financing. The Board shall have such
other duties and powers as provided by law.
    (b)  The State Board of Education shall appoint a chief
state educational officer.

"Illinois State Board of Education (ISBE) Board" consists of nine members who are appointed by the Governor with the consent of the Senate. Board members serve four-year terms, with State Board membership limited to two consecutive terms.

The board sets educational policies and guidelines for public and private schools, preschool through grade 12, as well as vocational education. It analyzes the aims, needs and requirements of education and recommends legislation to the General Assembly and Governor for the benefit of the more than 2 million school children in Illinois.

"Illinois Association of Regional Superintendents of Schools (IARSS)" supports ROE (defined below) in promoting quality education for the school children and citizens of IL by providing educational leadership, impact public policy, and deliver educational services for school districts, other educational entities and educational system clients of all ages.

The Regional Superintendent of Schools is the chief administrative officer of a Regional Office of Education, and the only elected education professional office in Illinois. ROEs/ISCs are essential support offices partnering with the Illinois State Board of Education to support local school districts.

As an intermediate agency between the Illinois State Board of Education and local school districts, the office of the Regional Superintendent performs regulatory functions as directed by the Illinois School Code. The Code states that “the Regional Superintendent of Schools: “In the performance of this duty he shall...

  • exercise supervision over all school districts in the region.
  • act as the official advisor and assistant of the school officers and teachers in his region.
  • carry out the advice of the State Superintendent of Education.”

In addition to coordinating and delivering state and local services, the Regional Superintendent acts as an advocate for education by providing positive leadership and disseminating information for educators, school districts and the public. Specific duties of the Regional Superintendent are stated in the School Code and can be summarized in two major areas, service and assurance to the public.

"Regional Office of Education (ROE)" The Illinois Association of Regional Superintendents of Schools represent 35 Regional Offices of
Education (ROE) and 3 Intermediate Services Centers (ISC). These 38 offices are represented by the Illinois Association of Regional Superintendents (IARSS). The organization serves 6 geographic regions that represent all school districts in the State of Illinois. Each area works together to ensure that all services are offered to schools districts in the state. The ISC’s are operated by a Director that serves the Superintendents of their geographic region.

"Office of the General Counsel – Public Inquiry" - Provides legal advice and legal resources to the Board, the Superintendent, agency staff, Regional Superintendents, and other education stakeholders to enable them to establish and implement education policy in line with the Board’s vision, mission, and goals and in compliance with State and Federal Law. In addition, the Office of the General Counsel manages Teacher Misconduct proceedings, Tenured Teacher Dismissal Hearing Officers and Decisions, and investigations into matters of public concern. "Public Inquiry" - A process commonly used by governments to evaluate a matter of public concern in a fair and transparent manner.  ISBE uses the Public Inquiry Process only when matters of public concern related to the schools or local educational agencies are systemic in nature and may threaten the rights of students.  This process is used at ISBE’s discretion to determine the facts of a particular matter in a fair and transparent manner. Definitions

"ESSER Fund" is a contract with stipulations and the county or city funding recipient must prove they are in compliance.

ARP ESSER”- The American Rescue Plan Elementary and Secondary School Emergency Relief Fund authorized under the American Rescue Plan (“ARP”) Act of 2021 provides nearly $122 billion to States to support the Nation’s schools in safely reopening and sustaining safe operations of schools while meeting the academic, social, emotional, and mental health needs of students resulting from the coronavirus disease 2019 (“COVID-19”) pandemic.

LEAs” - Local educational agencies.

"SEA's" - A State educational agency. The U.S. Department of Education must approve a “SEA’s” plan in order to make the State’s remaining ARP ESSER allocation available for use.

"Consolidated District Plan" - the mechanism to help district teams blend and braid funds and to report such plans to the state. It includes how the anticipated programs will be funded.

"CARES Act" - The Coronavirus Aid, Relief, and Economic Security Act (CARES Act), signed into law March 27, 2020, provides over $2 trillion of economic relief to workers, families, small businesses, industry sectors, and other levels of government that have been hit hard by the public health crisis created by the Coronavirus Disease 2019 (COVID-19). By implementing the CARES Act, Treasury is taking unprecedented steps to preserve jobs in industries adversely impacted by the spread of COVID-19. Title IV, Subtitle B of the CARES Act provides up to $32 billion of direct financial assistance to passenger and cargo air carriers and respective contractors that must exclusively be used for the continuation of payments of employees’ wages, salaries, and benefits. Title V of the CARES Act established the Coronavirus Relief Fund for the purpose of providing $150 billion in direct assistance to States, units of local government, the District of Columbia, U.S. Territories, and Tribal Governments.

Under Title IV of the CARES Act, Treasury OIG is assigned responsibility to audit certifications made by passenger and cargo air carriers and contractors that do not report to the Department of Transportation. Under Title V of the CARES Act, Treasury OIG is assigned responsibility to conduct monitoring and oversight of the receipt, disbursement, and uses of Coronavirus Relief Fund payments. Treasury OIG also has authority to recover funds in the event that it is determined a recipient of a Coronavirus Relief Fund payment failed to comply with requirements. As part of carrying out this function, we established the Coronavirus Relief Fund (Title V) portal via GrantSolutions into which recipients of Coronavirus Relief Fund direct payments must report quarterly.

Overall, Title IV and Title V involve very large dollar amounts. As such, Treasury faces immense challenges in ensuring that the programs achieve their intended purpose, provide for accountability and transparency, and are free from fraud and abuse. As such, our audit and investigative oversight of Treasury's implementation of Title IV and V are to evaluate management's accountability, control, and oversight of the Department's funds and provide recommendations for improving operations and preventing fraud, waste, and abuse with respect to those funds.

"Coronavirus Response and Relief Supplemental Appropriations (CRRSA) Act, 2021" - Public Law 116-260, enacted on December 27, 2020 includes $900 billion in supplemental appropriations for COVID-19 relief, $14 billion of which will be allocated to support the transit industry during the COVID-19 public health emergency, was signed into law.

"Governor’s Emergency Education Relief (GEER) Fund" - Received funding from both the CARES Act and CRRSA Act. The purpose of the Governor’s Emergency Education Relief (GEER) Fund is to provide additional support to K-12 and Higher Education institutions that have been most significantly impacted by COVID-19. Funds received through GEER may be leveraged flexibly by Governor’s to address identified needs within their state, and are intended to supplement funds received by impacted institutions through the Elementary and Secondary School Emergency Relief (ESSER) and Higher Education Emergency Relief (HEER) Funds.

This letter, along with Illinois’ approved ARP ESSER State plan, will be posted on the U.S. Department of Education’s (Department’s) website, and the Department will immediately release the remaining one-third of your State’s ARP ESSER allocation for your use. "

Tips and Tricks

Public school ESSER funding is publicly available and the trick is finding it on the local district's school board website > look for Sept./Oct. minutes (this is when board votes on budget) > and looking for FY22 budget. Every state is different in that regard, but the District Plan usually has all that info and every District Plan in every district in America is exactly the same template.

Depending on where your private school is, its ESSER funding will be through the public school in the same “district.” For example, there are two public schools in town and the private school is on the same side of town/district as public school B, not public school A. ESSER funds will be coming from district B.

  • Knowing this you want to send FOIA to ISBE (see "How To" below) to request a copy of the application submitted by the principal of the private school, the district and how they intend to use the funds.
  • You can FOIA the public school to see what funds were allocated to your private school. OR you can FOIA ISBE for the information.
